South Korea envoy nominee Mwende Mwinzi has secured a major victory after the High Court on Thursday ruled that she cannot be compelled to renounce her US citizenship.

While delivering his ruling on the matter, Justice James Makau said Mwinzi is protected by the constitution. 

He also said that the mother of the nominee was from the US and she is an American hence she cannot be forced to renounce the same so that she can assume the new role in the office. 

“I have no hesitation to agree that citizenship by birth cannot be taken away by anyone," he ruled

He also asked the Members of Parliament to reconsider the matter after the disagreement over the same 

"Considering the position of the matter is still in progress, it's not complete and the process should be allowed to be completed," Justice Makau further stated. 

Mwende has insisted that she will not renounce her American Citizenship. Parliament had affirmed that she had no right to assume the position as long as she remains an American citizen. 

Mwende opted to seek legal redress from the High Court after MPs maintained their stand. 

The new development opens another battle in Parliament as Mwende looks forward to assuming her new office without renouncing American Citizenship.
