Orange Democratic Movement treasurer Timothy Bosire says he was innocently charged by the state over alleged incitement in 2016.

For almost three years now, Bosire along with MPs Junet Mohamed (Suns East), Florence Mutua (Busia) and Aisha Jumwa of Malindi have been fighting to clear their names.

The four along with Jonhstone Muthama and Moses Kuria were locked at Pangani Police station for four days before being charged of incitement.

Principal Magistrate Martha Mutuku on Thursday dismissed the case as defective, giving the four freedom that they have been fighting for three years.

"The case is hereby declared defective and dismissed forthwith," she ruled, as defense counsel Dr John Khaminwa welcomed the judgement.

The former Kitutu Masaba MP said the things his team was fighting for including runaway corruption, were real, adding that the government has since taken charge.

"We were fighting for a better country, free of corruption. Currently, the government is dedicating it's efforts towards what we were demanding for in 2016," he said.

Mr Bosire, a close ally of ODM leader Raila Odinga, lost his seat to Jubilee's Shadrack Mose, even though he accused the state of rigging him out.

Although he's yet to formally declare interest in Nyamira gubernatorial elections, Bosire is one of the leading aspirants in the race to succeed Governor John Nyagarama.

In 2016, he refused to stand in Parliament, protesting the manner in which the government was allegedly treating families of soldiers from the region who died in Somalia.
