Dennis Itumbi has changed tune after claiming that a ruling blocking corruption suspects from office targeting Deputy President William Ruto allies was out of order.
Itumbi on Friday took to social media and apologised over his earlier stand noting that he now supports the war against graft.
"My sincere apologies, I change my position on the Court of Appeal decision. I fully support the decision ( I had read the Media instead of the decision)1. The decision does NOT amount to removing a Governor. The Governor, even if charged is still Governor2. Nothing in the structure and function of a Governor interferes with 3. Office clearly defined," he said.
He added"4. Aceca 62(6) - was NOT in consideration at the High Court and at the appeal. The section provides as follows - " This section shall NOT apply with respect to an office if the constitution limits or provides for the grounds upon which the holder of the office may be removed or the circumstances in which the office may be vacated"
The remarks come after the Court of Appeal upheld the ruling by Justice Mumbi Ngugi, which blocks all governors linked to graft from accessing offices.
While delivering the ruling on the matter, Justice Jamila Mohammed said that graft must be fought from all corners.
The ruling is a major blow to Governors Mike Sonko (Nairobi), Moses Kassaine (Samburu) and Ferdinard Waititu of Kiambu.
Justice Mohammed said the public officers linked to graft are not supposed to be allowed to hold positions in government until they are cleared.
