The case is now expected to be heard on Monday before the commission makes an announcement over the same.

While delivering the ruling, presiding Judge Byrum Ongaya on Wednesday asked the different parties to file the case and then serve their relevant submissions before the case continues.

The judge also said that the directive barring the commission from recruiting a new CEO following the resignation of the former officer holder Ezra Chiloba  remains in force.

The Wafula Chebukati-led commission had asked the court to dismiss the case in order to pave way for the recruitment process to continue as required.

The commission has maintained that the process was procedural after it emerged that it had some issues to do with transparency.

Chama Cha Mawakili had moved to court challenging the recruitment process.

“Pending the hearing of the case, there be a stay of the process of recruiting, selecting, interviewing, appointing or otherwise filling submission for the vacancy in the office of secretary and Chief Executive Officer of the second respondent (IEBC),”Justice Ongaya said as quoted by Citizen Digital.
