A woman has moved before the Nakuru High Court seeking orders to exhume her husband’s body to give him a decent burial.

Lucy Muthoni who wants to be given a permit to exhume her husband told the court that her husband died on September 22, 2005, and was buried a week later at Nakuru Cemetery.

Muthoni said they were forced to bury Samuel Kimangu’s body in Nakuru after the family disputed on where he would be buried after his death as a result of immuno-suppression syndrome due to Anemia.

Muthoni said the family did not agree on whether Kimangu should be buried at his ancestral home in Nyeri or at his residence in Nakuru.

Lady Justice Rachel Ng’etich heard that after 14 years, the family agreed to resolve their issues and have Kimangu buried at his ancestral land.

“The family of the late have resolved their disputes and wish to lay the deceased to rest by giving him a decent burial at his father’s home in Othaya,” read Muthoni’s application as quoted by Standardmedia.

Muthoni who also wants the court to urgently give her permit to rebury the deceased’s body in Nyeri said the land in Nyeri belongs to Kimangu’s father, Benjamin Macharia.

“If the orders are delayed, my wishes may not come true as my age is quickly catching up with me and I was recently diagnosed with cancer,” she said.

Justice Ng’etich directed Muthoni to serve the application to the ex-parte which are the republic and Medical Health Officer Nakuru.

The case will be mentioned on October 2 when the court will give direction in the matter.
