A man was convicted in the high court in Kakamega for killing his uncle who allegedly allowed chicken to cross over into his farm.
Judge Ruth Sitati who was sitting in for Presiding Judge William Musyoka declared Gabriel Anami guilty of the offense saying the prosecution had proven their case beyond any doubt.
Justice Sitati further pointed out that cuts on the body of the deceased indicated that the suspect had intention of either killing or causing grievous body harm.
“I am satisfied the witnesses placed the accused squarely at the scene of crime thus there is no issue of mistaken identity,” Judge Sitati stated.
Standard Media reported that David Otuya Shiroko who was murdered by Gabriel Anami was a brother to his father.
According to Mariam Amagore who was also a witness in the case, she had a sound of a person cutting something while she was watching in her house.
On rushing outside, she found the suspect holding a panga which was stained with blood as the body of the late uncle lay not do far from him. She consequently raised an alarm which made the suspect to flee away.
The suspect successfully pleaded for a week to prepare his mitigation before being sentenced. The sentence will be read on October 23.
