Thirdway Alliance party leader Dr Ekuru Aukot has lashed out at High Court Judge James Makau for temporarily halting the debating or approval of his (Aukot) Punguza Mizigo push.

In his ruling last week, the judge directed that the bill is to remain stagnant for 14 days to allow other parties named in the petition respond.

He was acting on a petition by David Kamau Ngari who argues that there is no referendum law to facilitate the changes sought by Aukot.

Weighing in on the ruling on Sunday, Aukot fired shots at the judge over claims that he has joined a group out to scuttle the Punguza Mizigo drive.

He claimed that Justice Makau is being used by some political players on the opposite side.

"Of course, I'm very unhappy with that judgement but am also unhappy with that judge Makau. Justice Makau is being convenient, I think he is being used politically to frustrate this Punguza Mizigo. He is used by the opponents of this Punguza Mizigo," he said.

Aukot made the remarks in an interview on K24's Punchline, Sunday night.

In the petition, the Independent Electoral and Boundaries Commission (IEBC), Thirdway Alliance, 47 county assembly Speakers and the National Assembly and Senate Speakers have been listed as respondents.

In a rejoinder, Aukot termed the judge a rogue judicial officer tasked with the role of frustrating his constitutional changes bid. 

"The opponents of this bill are using a rogue judge in the judiciary to actually bar this process," he added.

At the same time, he noted that the ruling has nothing to do with him as a person or his efforts to have the proposals in the bid realized and passed into law.

"The court did not bar me Ekuru Aukot. It barred the county assemblies from debating and approving the bill," said Aukot.
