The office of the Director of Public Prosecutions (DPP) Nordin Haji has now questioned why The contractor Paolo Porcelli of CMC di Ravenna failed to appear in court over the multimillion Arror-Kimwarer Dam saga.
On Monday, special prosecutor for DPP Ali Taib asked why Paolo and other foreigners have developed the habit of defying court orders yet they expect to continue working on projects in the country.
Paolo said that it is unfortunate that the contractor cannot present himself in the court when billions cannot be accounted for.
“We've just received the application by Paulo. Paulo is just a fugitive and we see this repeated by foreigners who think they are above the law and consider themselves as dignified....to have a foreigner refuse to appear before the court,” he said.
The contractor is also wanted in South Africa over another saga.
A private investigator Paul O’Sullivan has asked for the extradition of the contractor to allow the South African government to prosecute him.
The South African government wants the contractor to explain why the project never kicked off yet it had received Sh20 billion for the project.
The firm had been awarded a tender to construct a container terminal in Durban City but it is evident something went amiss after it stalled in a similar manner to the Arror-Kimwarer project.
