The High court in Nairobi has barred Samburu County Governor Moses Lenolkulal from accessing his office without permission from the Ethics and Anti-Corruption Commission (EACC).

On Wednesday, Milimani High Court Judge Mumbi Ngugi said that the governor's constitutional rights have not been violated by a lower court ruling that barred him from accessing his office over graft charges he is facing in court.

Justice Ngugi said that Governor Lenolkulal must adhere to the conditions issued by the magistrate's court pending hearing and determination of his case.

“The application to reverse the lower court ruling on this subject matter lacks merit and the conditions issued by the Magistrate court must be adhered to by the appellate,” Justice Ngugi ruled.

Governor Lenolkulal had filed an application seeking the High Court to reverse orders by the Anti-Corruption Magistrate court that barred him from accessing his office pending the hearing of his graft case.

The governor through his lawyer Paul Nyamodi argued that the order barring from his office was illegal and unconstitutional.

Governor Lenolkulal was in April arrested, arraigned in court and charged with abuse of office and corruption leading to the loss of Sh84 million at the Samburu County Government.

He pleaded not guilty alongside other accused persons. He was released on Sh10 million bail.
