A High Court in Nairobi on Thursday threw out a case that sought orders to declare Nairobi Governor Mike Sonko unfit to hold public office.
The case had been filed by lawyer Boniface Nyamu.
High Court Judge James Makau delivered the ruling.
Addressing the press outside the court after the ruling, Nyamu claimed that the verdict was not fair constitutionally.
He blamed the court for shying away from making the actual decision since the conduct of the governor was to be declared unfit. He also condemned the court for focusing on technical issues rather than facts.
"The court shied away from making the crucial decision from the conduct of the governor. He (Sonko) ought to have been declared unfit to hold public office. Instead, the court went on technical issues and through that, it has no jurisdiction," Nyamu noted.
The lawyer vowed to continue seeking justice and revealed that he plans to file a petition at the court of appeal on Monday.
"Upon receiving verdict this morning, I have received instructions from my client and we will be proceeding henceforth to file an appeal so that we have a judgement reviewed on merits and have a meritorious decision of that matter," he said.
In his petition, Nyamu had sought the court to declare Sonko unfit for among others assaulting a Member of Nairobi County Assembly and failure to pick a deputy governor.
