Eldoret high court has directed AIC Chebisaas Boys High School to readmit suspended students when the school reopens in September.
On Wednesday, Justice Stephen Githinji who read the order instructed the school to allow the students to report back with the rest pending the hearing and determination of the case.
The Star quoted the petitioner's lawyer Eliud Miyienda on Wednesday saying; “We agreed that the students should not miss their classes as we deal with the case in court.”
The court argued that the students had missed classes after wasting a substantial period of time, hence it was necessary for them to be allowed to resume their studies.
The school had suspended the students for refusing to sit for exams on Saturday because according to them (students), it was a Sabbath day, a day of rest and worship for the SDA church faithful.
Parents of the affected students had filed a suit challenging the suspension, arguing that the school disregarded the constitutional guarantee of freedom of worship.
One of the parents, Irene Ng'etich castigated the school for making the move which had made students miss school for a whole term.
“When the students exercise their constitutional right to worship that does not amount to indiscipline but it goes towards building good character,” Ng'etich was quoted by The Star.
However, the school principal Samwel Ng’ang'a had filed a defence suit, claiming that the school was rooting for harmony and equality amongst students by ensuring that they adhere to the set rules.
He further asserted that preferential treatment was tantamount to disharmony.
