The Nakuru High Court on Monday allowed a woman to exhume her husband’s body 14 years after his death.

Lucy Muthoni Kimangu had moved to court seeking orders to exhume the remains of her husband, in a bid to give him a decent burial.

The court heard that the family was forced to bury Samuel Kimangu’s body at Nakuru cemetery following a dispute on where he would be buried after his death in 2005.

Muthoni, however, told the court the family agreed to resolve their issues and have Kimangu buried at his ancestral land in Nyeri.

The court, last week, asked Muthoni to provide proof that the family reconciled before granting her application.

Muthoni through lawyer Philip Mburu, told the court the family had resolved their differences, with members of the family present in court confirming the same. 

Kimangu’s brother Joseph Macharia told Justice Teresia Matheka that both families had agreed to bury his brother at their ancestral home.

“We are here to confirm that the family wants Mr Kimangu buried at our ancestral home in Othaya, Nyeri County in accordance with Kikuyu customs,” Macharia said as quoted by Nation.

Justice Matheka in her ruling granted the application and allowed Muthoni to exhume the remains of Kimangu for reburial in Nyeri.

“I can confirm that the families are in agreement and there will be no issues if the deceased is buried at his ancestral home in Nyeri,” ruled Justice Matheka.
