City lawyer Donald Kipkorir continues to poke holes into the decision by Independent Electoral and Boundaries Commission to clear footballer McDonald Mariga to contest Kibra by-election.
On Monday, IEBC chairman Wafula Chebukati ruled that Mr Mariga, despite later registration, is eligible to run for Kibra by-election following the death of Ken Okoth.
But Mr Kipkorir believes that several regulations were not followed by IEBC before clearing him. According to him, he did not sign the reference book.
And the vocal lawyer, in what could cause yet another controversy, claimed that Mr Mariga, a former Harambee Stars and Inter Milan midfielder, is currently 41.
"To register as a voter, you must produce ID, fill and sign the application form and sign the IEBC Reference book. When a Vacancy is declared, registration is suspended. McDonald Mariga, 41, disobeyed all above. Kibra voters must reject him with contempt," he said.
Leina Konchellah has already petitioned IEBC to pronounce itself on the age issue, failing which, she says, she may move to the High Court.
In her sworn submission filed with the electoral agency, Ms Konchellah says there could be integrity issues with the documents Mr Mariga submitted to the commission.
“It is curious to note that the complainant presented a national identity card indicating his date of birth as April 1987 and further presented his Kenya Certificate of Secondary Education indicating he sat his Form Four examinations in November/December 2002,” says Konchellah.
She continues: “From the above, it means that the complainant sat his Secondary School examinations at the age of 15, which is rather unusual. And if the same is calculated backwards, it means the complainant enrolled for Class One for his primary school education at the age of three.
“This can only lead one to conclude that the complainant was either a genius at Primary School level, which brilliance abandoned him at Secondary level for him to get a mean grade of D-(minus), or there are integrity issues as to authenticity of the said documents he presented before the IEBC,” reads the submission.
In a previous interview, Mariga's father Noah Wanyama claimed that his eldest son was born in 1981. In subsequent interviews, he changed his earlier position.
There are also reports that two journalists were previously threatened when they tried to interrogate the age of Mariga. His ID indicate that he was born in 1987.
