Deputy Chief Justice (DCJ) Philomena Mwilu is unfit to hold public office, the Director of Public Prosecutions (DPP) Noordin Haji has insisted.
The DPP on Thursday filed a petition with the Judicial Service Commission (JSC), seeking for the removal of Mwilu from her position as Deputy Chief Justice.
In the petition, Haji argued that the DCJ was involved in irregular purchase and sale of property, and also claimed that Mwilu failed to pay taxes to the Kenya Revenue Authority, thus unfit to hold public office.
According to the DPP, DCJ used her office as the deputy president of the Judiciary to advance personal interests.
"The Judicial Service Commission be pleased to find that there are sufficient and overwhelming grounds for recommending to His Excellency the President that a Tribunal be appointed to inquire into these events and particularly to find reason for the removal of the Respondent from office, station and position of the Deputy Chief Justice,” Haji's petition read in part.
The Judicial Service Commission is an independent body charged with the duty of hiring judicial staff, investigating complaints, and misconduct against judicial staff.
Judges and magistrates can only be removed from office after being investigated and found guilty by the commission.
