A High Court on Wednesday released a man identified as SOM after spending two years in prison.
High Court Judge Luka Kimaru while issuing orders to set free the man said he had been wrongfully jailed after his nine-year-old daughter was forced to lie by her teachers who wanted to keep her.
SOM was jailed for life in 2017 by a Magistrate's Court in Nairobi after his daughter's testimony. He was being accused of defiling his daughter.
“In the present appeal, it cannot be ruled out that the complainant may have been influenced by those people who interacted with her to make allegations against the Appellant which had no basis in the truth," ruled Justice Kimaru as quoted by the Standard Digital.
Despite medical evidence that the father of six didn't defile his daughter, the court had gone ahead to sentence him to life imprisonment.
However, the man appealed and his lucky doors were unlocked as the High Court judge released him accusing the complainant of being influenced in her decision to testify against her father.
According to the man, his daughter's teachers wanted custody of his children. However, he refused to let them go something that triggered bad blood between them.
They started looking for ways to remove him from the equation and that's when they forced a rape case on him.
Before the incidence, the man was living with his two daughters and his son in a two-roomed house. The mother of his children lived in Migori.
