The prosecution team through prosecutor Alexander Muteti made the submission after Waititu moved to court seeking for review of a court ruling that saw him barred from accessing his office until the case is heard and determined.

The governor also urged the court to review the Sh15 million cash bail and Sh30 million bond slapped on him by the lower court.

Through his lawyer Prof Tom Ojienda, the county boss wants the terms reviewed to allow him to deliver his promises before his term ends.

Ojienda faulted Chief Magistrate Lawrence Mugambi for allegedly abusing his power while issuing the tough condition for bond.

“There is fragrant abuse of discretion by the lower court. It is no longer clear what guides courts in granting bond or the option of cash bail,” said Ojienda, as quoted by Citizen Digital.

Waititu has insisted that he will continue discharging his duties to the people of Kiambu despite being barred from accessing his office.
