A Kakamega count has slapped a man with 15 years jail term after he was convicted for defiling his daughter, in an appeal where she thought to overturn a magistrate court's verdict.

The man identified by initials JKO was on Tuesday arraigned before High Court Judge Hedwig Ongudi, who heard that he committed the crime on the form two girl on September 16, 2016.

The court was told that the suspect took advantage of the form two girl when she was sent home over unpaid fees, and raped her at their home in Shirere, Kakamega Central.

The prosecution said that JKO sent the daughter to go fetch him drinking water in the bedroom, but followed her in there half naked, insisting to confirm if she was still a virgin.

Her attempts to save herself were futile as the father was too strong for her, after which he warned her against saying a word to anyone.

Justice Ongudi was told that the girl, whose mother died when she was young, told her stepmother about the incident, but she failed to "investigate" it as she had promised to.

In his ruling, the judge found that JKO betrayed the girl's trust in him, ruling that what transpired will never slip out of her mind.

However, he annulled the magistrate's court verdict which had slapped JKO with 20 years.
