Lawyer Charles Kanjama has claimed that the Tuesday ruling against Kiambu governor Ferdinand Waititu doesn't suspend him from his position as an executive county leader.
In her ruling, High Court Judge Justice Mumbi Ngugi, while releasing the governor facing corruption charges on cash bail, ruled that he is not to access his offices until the court in heard and determined.
And though the ruling apparently technically suspends the governor, as he cannot access the seat of power, Kanjama is of the opinion that thisnis not the case.
Speaking on Citizen TV on Tuesday night, he opined that the ruling only prohibits his presence at the offices and contact with officials, some of whom double up as witnesses.
"The court gave conditions for granting bail- that there should be no access to physical offices or interference with witnesses. This did not amount to a suspension," he said on News Night show.
According to the lawyer, Waititu and any other county boss in his situation can choose to operate from else where, as long as they stick to the bail terms.
"My reading of the ruling is that Governors are still entitled to dispel their duties as long as they do not physically access county offices and have no contact with witnesses," he added.
This comes at a time when Waititu's deputy James Nyoro has since announced a takeover of Waititu's slot for the time he will be out.
However, the governor spent another night in prison after failing to process his bail in time.
