The former Makueni Senator late Mutula Kilonzo was not a happy man when ex-Vice President Kalonzo Musyoka toured various African countries in a bid to pull Kenya out of the Rome Statute.

The Ukambani political kingpin made the move following the naming of President Uhuru Kenyatta and his Deputy William Ruto among the suspects behind the 2007/08 Post Election Violence (PEV). 

The late Kilonzo said Kalonzo was not doing the right thing when he went around seeking to 'interfere' with the then infamous Ocampo 6's prosecution.

The other suspects implicated in the post-election violence that left over 1,500 people displaced included the former head of public service Francis Muthaura, ex-police commissioner Hussein Ali and radio journalist Joshua Arap Sang. 

“Looking at the newspapers, he says that he is lobbying African countries for deferral of ICC cases. Unfortunately, the Rome Statute has no provision for deferral and national crime act has no provision for referral,” Kilonzo said.

The late Kilonzo wanted Kalonzo, who said the mission was successful, to stay away from the mission and wait for justice to take its course following the revelation.

President Kenyatta and the other suspects accused of committing crimes against humanity were set free after the Hague based court dismissed their cases for lack of substantial evidence.

The cases shaped the race for the presidency in 2013.
