Embattled Deputy Chief Justice Philomena Mwilu is fighting her ouster from office after several quarters launched petitions seeking her removal.

Mwilu, who has been accused of abuse of office, now wants all the petitions pushing for her ouster postponed until the outcome of the Court of Appeal determines her case. 

She has objected the hearing of her case at the apex court when the lower courts are yet to determine.

In her application, Mwilu appealed to the Judicial Service Commission not to consider the case presented before it by the Director of Public Prosecution (DPP) as well as three other petitioners seeking to oust her. 

Mwilu said that DPPNoording Haji obtained the evidence against her in an unfair manner. She also said that the DPP had already been condemned by the High Court, adding that no other case should proceed.  

The DCJ's defence team said that the way in which the DPP obtained the evidence was against the administration of justice. Mwilu accused the DPP of abusing the system as he seeks her removal from office.

“The DPP and the other three petitioners are clearly abusing the system of administration of justice by seeking a different outcome before the JSC, having failed to achieve the same before the Chief Magistrate Court and the High Court,” she said.

Haji had indicated that he has sufficient evidence against Mwilu before the High Court ruling.
