A man has incurred a great loss after losing his eight parcels of land within Kisumu county over an unpaid loan taken by his wife using the pieces of land as security.

Gabriel Otieno's wife Birter Nyaboke took Sh3 million loan from the Kenya Women Finance Trust (KWFT) and used the money for business purposes, but is yet to repay the loan.

Despite his claims that the land documents were taken without his consent, Justice Stephen Kibunjia gave the trust the green light to sell off the plots to recover the loan.

This is after Otieno moved to court in a bid to prevent the planned disposal of his plots.

In his ruling, quoted by the Standard on Sunday, the court said that Otieno, in his appeal, did not convince the court that he did not receive notices demanding that they repay the loan.

“That as the Appellant has not disputed the address attributed to him, the issue of whether or not he indeed received the notices is an issue to be pursued during the hearing of the main suit, which is still pending in the lower court,” reads the ruling in part quoted by the Standard.

The court sided with the trust that the appellant and the wife did not abide by the loan terms, hence allowing the sell of the plots to recover the loan.
