City lawyer Steve Ogolla has poked holes into the 'Punguza Mizigo' Bill 2019 terming it unconstitutional.
Ogolla quoted proposals on the war on corruption as some of the recommendations in the former presidential candidate Ekuru Aukot-sponsored Bill which is against 'settled constitutional safeguards on fair trial'.
In a tweet on Friday, the lawyer said the much-hyped Bill had also attempted to rewrite the Constitution instead of pointing out a single issue in the supreme law which needed to be changed.
"Punguza Mizigo Bill is unconstitutional for attempting to reverse settled constitutional safeguards on fair trial, ostensibly to boost the war on graft. Secondly, the Bill is imprudent for conflating issues. Amending the constitution by referendum ought to be a single issue Bill," Ogolla tweeted.
Aukot proposes an amendment of Chapter 6 of the 2010 Constitution to bar all individuals adversely mentioned in corruption from holding any public or state office and also tough punishment for convicts.
"Corruption and theft of public resources cases to be tried within 30 days and all appeals to be exhaustively concluded within 15 days," reads part of Punguza Mizigo Bill 2019.
"Impose a life sentence for suspects convicted of corruption and theft of public funds. No presidential pardon and amnesty will be applicable in those cases," it adds.
County Assemblies have three months to pass or reject the Bill which also seeks to minimise the burden of over-representation on taxpayers.
