Weston Hotel has a big win in a land case it is involved in after The Kenya Commercial Bank (KCB) presented in court that the hotel's title deed of the controversial land was genuine.

According to the Bank, it loaned the hotel Sh1 billion after investigating the documents associated with the land and arrived at the conclusion that they were authentic.

Reports indicate that the Ministry of Lands and Physical planning together with the Lands Registrar have confirmed to KCB the authenticity of the land.

Weston Hotel which is linked to Deputy President William Ruto is engaged in a legal case with the Kenya Civil Aviation Authority (KCAA) which is claiming ownership of the land.

KCAA has demanded the hotel to be consequently demolished. Weston Hotel, on the other hand, wants the case to be terminated and for the court fees to be settled by the KCAA.

Documents presented to the court by KCB through its legal representative Emmanuel Wetangula confirmed that indeed the hotel had taken a loan from the bank in 2014 and 2015.

“It is on this assurance that the interested party agreed to advance the loan facilities to the second respondent (Weston) on the firm understanding, belief and expectation that in case of default, it would be entitled to exercise its statutory power of sale over the suit property,"  KCB stated in the court papers.

The National Land Commission had initially ruled in favour of KCAA and directed Weston Hotel to compensate the aviation authority.
