The High Court has postponed the sentencing of former Kenya national rugby players Frank Wanyama and Alex Olaba until August 16, 2019.
Chief Magistrate Martha Mutuku directed that the two, who were found guilty of gang rape on Thursday, to remain in custody until the day of their sentencing.
However, their lawyer, Jimmy Wafula Simiyu asked the court to consider giving his clients a lenient sentence.
According to Simiyu, the two have no criminal records and have been obeying all the court orders.
“It’s been a very depressing period for them, they have been discontinued at their respective universities and have not participated in a single match in their team,” he said.
Furthermore, Simiyu stated that they are breadwinners of their families.
“They are just starting life, they come from humble backgrounds and they have been able to help their families. The first accused has seven siblings while the second accused has four siblings. We pray that you take that into account,” he added.
However, the court refused to listen to Simiyu's pleas maintaining that the two will act as an example to other youths who flout the sexual offences Act.
The court argued that they should be sentenced for a minimum of 15 years in jail each.
The Prosecution asked the court not to listen to the defendants' lawyer arguing that their client suffered in their hands.
“The complainant was intoxicated but there is nowhere the accused persons say they were intoxicated,” noted Prosecution.
