Former Kiambu Governor William Kabogo has suffered a major blow after the court ruled against him in a Sh100 million case involving a Nairobi businessman.
Kabogo had attempted to stop the multimillion case of the disputed parcel of land in Westland's but he failed.
Kabogo had earlier been directed to compensate the businessman for trespass over the land before he resolved to seek assistance from an upper court.
In his ruling, the Appellate Court said Environment and Land Court Judge Elijah Obaga said that there is no sufficient evidence to rule in favour of the county boss.
He also said that the ruling was given after the judges considered several aspects including the former governor’s valuation of the property, which was approximated at Sh1.8 billion.
Through Caroget Investments Limited, Kabogo said that the award of the said amount had no basis at all.
The politician said that he is entitled to occupy the said piece of land. The court ruled that the case has nothing to do with double allocation.
“One of shameless outright typical Kenyan style land grabbing, where Kabogo, in collusion with some of the officials working for the City Council, commissioner of lands, registrar of titles and the Attorney General, attempted to alienate private land that already had been alienated,” the court ruled.
Kabogo is yet to break silence after the court ruling.
