A High Court in Mombasa on Wednesday freed Ms Amina Shiraz Yakub who had been accused of killing her husband.
In her ruling, Lady Justice Dora Chepkwony noted that the prosecution, who had lined up a total of 18 witnesses failed to convince the court that the suspect killed or colluded in the murder of her husband, Jimmy Baburum.
“The prosecution must prove its case beyond any reasonable doubt,” said Lady Justice Chepkwony in her ruling as quoted by Daily Nation.
The Judge also noted that the prosecution witnesses had different stories of their testimonies.
She further said that two key witnesses gave different accounts of their stories in written and in audio, that meant they weren't sure of their statements.
Ms Amina Shiraz Yakub was being represented in court by lawyers Ahmednassir Abdullahi and Jared Magolo.
''Breaking News...The High Court in Mombasa acquitted Ms Amina Shiraz Yakub of the murder of her late Husband Mr. Jimmy Baburam 3 years ago in Watamu and held that she has no case to ANSWER,'' lawyer Ahmednassir Abdullahi tweeted.
Shiraz had told the court that her father in law was the one pushing the case against her in a bid to fight for his son's property and not his death.
The deceased was found dead in a swimming pool at the luxurious Medina Palms Resort in Watamu on 26 July 2015.
The Prosecution, through the Senior Assistant Director of Public Prosecutions Vincent Monda objected the court's ruling and the defence's sentiments in court.
“We disagree with the assertion that the witness (an eye witness) was coached to come and tell lies to the court,” said Mr Monda.
