Besieged Embakasi East MP Paul Ongili alias Babu Owino has moved to Milimani Law Courts to challenge his bail that was granted early this week.
Chief Magistrate Francis Andayi ordered Mr Owino to pay Sh10 million in instalments of Sh2.5 million in four months, an amount he says is beyond his capability.
On Thursday, Babu Owino said in an application that he will struggle to meet the remaining instalments as directed in the terms of bail.
“I have partially complied with the terms as set out and thus I am out on bail but I know that I thus would also appreciate an and above a reduction of the amounts stated being Ksh.10,000,000 million,” reads court papers filed by the MP, as quoted by Citizen Digital.
He also wants the Judges and Magistrates organization to be included in the case as respondents.
“Despite the fact that I had voluntarily started assisting the victim in meeting the medical expenses and had pledged to voluntarily continue doing so, at no point was it to depict an admission of guilt as the Court seems to have depicted and thus the same should not be used to render high or punitive bail terms,” argues Babu Owino.
The controversial MP is accused of shooting a city DJ who is currently recuperating at the Nairobi Hospital.
He denied the charges.
