A former Jubilee aspirant for the Kibra parliamentary seat, Morris Peter Kinyanjui has moved to the Political Parties Disputes Tribunal to challenge Macdonald Mariga clearance to vie in the Kibra by elections.
In his petition, Mr Kinyanjui has sued Mariga, Jubilee Party and has named the Independent Electoral and Boundaries Commission (IEBC) as the first respondent.
Kinyanjui alleges that the party nominations were not done as indicated in the party's rules.
“The applicant strongly believes that he has a prima facie case which is likelihood of success,” reads part of the petition as quoted by Citizen Digital.
According to the petition, IEBC's decision to clear the former international footballer was wrong.
He believes due process was never followed when selecting Mariga to represent the party in the Kibra by elections.
Therefore, Mr Kinyanjui wants the tribunal body to settle this case before the by elections, which are slated on November 7, 2019.
This comes just a day after Mariga was cleared by IEBC tribunal chaired by IEBC Chairman Wafula Chebukati.
In their decision, the body noted that Mariga is a registered voters.
His clearance has caused mixed reactions from a section of leaders from Jubilee and ODM.
Jubilee and ODM are considered favorites to clinch the Kibra parliamentary seat.
