Homa Bay Members of County Assembly (MCAs) Maurice Ogwang’ and Oscar Abotee were on Monday charged with physically assaulting assembly Clerk Daniel Kaudo. The two who represent Kendu Bay Town Ward and Kabuoch South ward respectively are alleged to have committed the offence on November 13 inside the assembly compound.
Ogwang’ and Abotee nonetheless denied the charges when they were presented before Senior Resident Magistrate Tom Mark Olando.
Godrick Okello, the lawyer, representing the two MCAs argued that the offence against his clients was common among politicians. He consequently requested for manageable cash bail.
“There is already a ceasefire in the assembly where the MCAs committed the offence, plus their case is common among politicians so I am appalling for a cash bail that they can manage,” he said as quoted by Nation.
Okello on behalf of his client tried to seek for a directive to bar journalists from taking photos of the two MCAs. The magistrate, however, turned down the plea.
The MCAs were released on a bond of Sh50,000 each. They were given an alternative cash bail worth Sh20,000 each.
The case will resume on November 29, 2019.
On Friday, Kojwach Ward MCA Joan Ogada together with her spouse Thaddiaes Ogada who allegedly took part in the same offence were charged before Senior Principal Magistrate Thomas Obutu.
