An Uber driver was on Monday arraigned in court to answer to charges of allegedly raping his client and stealing a phone.

Shem Mogaka Nyakundi was facing three counts of rape, stealing a Techno mobile phone worth Sh35,000 and handling suspected stolen property on November 22, 2019.

Inspector Eunice Njue told the court that on the material date, the accused person had picked the complainant from Lang’ata in Nairobi County and was to drop her at Ruiru, Kiambu County.

The accused, however, re-routed and went to his Tassia residence in Embakasi where he allegedly sexually assaulted her and kept her in his house for a whole day.

After committing the crime, the court heard that the accused ensured that the complainant had taken a shower and washed her clothes to destroy evidence.

The accused person denied the charges before the court and filed an application to be released on bail.

Inspector Njue, however, opposed the application and asked the court to detain the accused person saying they are yet to receive a medical report on the victim.

Njue further said that the accused person has been threatening the complainant and witnesses in the case adding that witnesses were still recording statements.

“A report from the hospital which treated the rape victim is yet to be received. It’s only the doctor who treated the complainant who can fill the requisite file.” 

“Upon learning the complainant had reported she was raped, he has proceeded to issue several threats against her and other intended witnesses,” said the police Inspector.

Magistrate Muthoni Nzibe ordered that the accused person be detained for 18 days to allow the Prosecution to complete their investigations.

The case is set for mention on December 19.
