Machakos Governor Alfred Mutua has been acquited the charges of the alleged fradulent purchase of 16 motor vehicles for the county government.
The EACC and DPP reached a consent with the governor at the Court of Appeal on Wednesday.
The parties have also agreed to bear the individual cost of the case that had been filed at the appealant court.
"This appeal be and is hereby marked as withdrawn in terms that EACC and DPP undertake not to institute any criminal charges against the appellant."
The consent was reached in relation to EACC inquiry file no EACC/FI/INQ.51/2014, being an inquiry into the allegation of irregular purchase of 15 Subaru Outback vehicles and a Toyota Landcruiser.
The EACC and DPP undertook not to institute any criminal charges against the governor as they were the subject of a criminal case in Machakos court.
All accused persons in the said case were acquitted.
The consent was recorded before Roslyn Nambuye, Otieno Odek, and Asike Makhandia.
Mutua had moved to the Court of Appeal to challenge High Court decision that dismissed his petition to stop his prosecution for fraud
In an assent marked and displayed in court, the Ethics and Anti-Corruption Commission (EACC), the Director of Public Prosecution and the Attorney-General consented to cease from having him accused of the said claims.
The court was informed that there was at that point a current criminal case on the issue under the watchful eye of a Machakos court and all the denounced people have since been absolved.
Justice Isaac Lenaola, however, rejected his suit in 2016 citing the absence of legitimacy.
Mutua said the supposed unlawful buy of the administration vehicles in 2013 was a witch-chase coordinated by his spoilers.
The governor took to social media to thank his supporters and legal team for the support he was accorded before the case.
“I thank the Almighty God for his blessings. Thanks to my family, legal team & colleagues for their support. Thanks also to the DPP and his office, together with EACC and the AG for assenting & clearing me of integrity allegations that were always politically instigated,” Mutua posted on his Facebook page.
