Majority Leader in the National Assembly Aden Duale has received a backlash from Chief Kadhi, Ahmed Muktar and his predecessor Ahmed Kasim for undermining the jurisdiction of the Kadhi office.
Speaking at Ronald Ngala Grounds on Wednesday in Mombasa, the duo accused Duale of stoking rebellion and uncalled for division among the Muslims over the exact date of Idul al- Adha celebrations.
The Chief Kadhi opined that the section of Muslims who observed the day on Tuesday overlooked fundamental Islamic issues that ought to be followed to the later.
He said based on the lunar calendar, the day was supposed to be marked on Wednesday and not on Tuesday, besides cautioning the politicians against politicising a religious matter.
“Praying on the day that is not prescribed (by Islamic law and tradition) means you did not observe Idd ul Adha. It is like fasting outside Ramadhan or observing Idd ul Fitr outside the month of Shawwal,” said al Muhdhar.
“You do not even need an Imam to know when to observe this day because all of us are under obligation to observe the lunar calendar,” said al Muhdhar.
The vocal Jubilee leader dismissed an earlier proposition by the Chief Kadhi that urged Muslims faithful to collectively marked the celebrations fate on Wednesday.
The Chief Kadhi made the statement following a Gazette notice made by the CS Matiangi who declared Tuesday as a public holiday for Idd day commemoration.
Duale, while speaking at General Mohamud Ground on Tuesday, Garissa, where he joined a mammoth Muslim faithful to mark the Idd day, told off the Kadhi saying that his constitutional mandate entailed solving marriage disputes, divorce and inheritance as, he said, per article 170 of the constitution.
“He (Chief Kadhi) has no business guiding the Muslim on the day they should perform their Idd ul-Adha or Idd-Ul-Fit. He should stick his constitutional mandate which is: Adjudicating matters relating to marriages, divorce, and inheritance," said Duale.
The annual Islamic celebrations which ordinarily fall on the 10th day of Dhul Hijah, the 12th month of the Islamic calendar, has divided the Muslim faithful, with a section commemorating the day on Tuesday while others observed it on Wednesday.
The day is dedicated to imitating the obedient act of prophet Ibrahim who willingly followed the commandment of God to sacrifice his son- Ismail -before Almighty God exchanged him( son) with a ram.
