With the abolition of hanging for murder and robbery convicts, many inmates being held for these crimes are not hopeful if securing their freedom from prisons.
This dates back to 2017 when two inmates; Francis Kariuki Muriateti and Wilson Thirimbu, challenged the mandatory death sentence foe capital offenders at the Supreme Court.
The court ruled abolished the sentence, ordering that these awaiting their hanging to reappear before the High Court for resentencing, which has seen some walk free.
Though the two petitioners are still cooling their heels at the Kamiti Prison, thanks to their efforts, some capital offenders have been released after a closer look at their said crimes.
A good example is Peter Matiku Muhiru who was released by Justice Luka Kimaru after spending 16 years in prison for robbing Mr Peter Mburu Gikonyo, a Naivasha businessman, Sh2,570 in October 3, 2001.
The Garissa duo of Aden Sharif and Arte Abdi Wito is also a free after being convicted for killing Haji Omar Ibrahim.
However, the fate of others remain unknown due to missing files, some of which can not be traced, with those whose cases arw yet to be reheard forming the bulk.
However, others have not been lucky after judges re-convicted them afresh after throwing out their arguments.
