Three judges are on Thursday expected to visit Mzee Jomo Kenyatta's statue at Kenyatta International Conference Centre to establish whether or not it's part of the building.
Activist Okiya Omtatah had on Wednesday asked the High Court judges to visit the scene before making a ruling on the case involving him and Central Bank of Kenya over new bank notes.
Justices Anthony Mrima, Kimondo Kanyi and Arsenath Ongeri had directed him and other respondents to argue the application on Thursday morning, after which they will make a ruling on the matter.
Activist Okiya Omtatah has faulted the Central Bank of Kenya for retaining the image of Mzee Kenyatta on the new currency notes.
In the petition, Mr Omtatah accuses CBK and its Governor Patrick Njoroge of contravening Article 231(4) of the Constitution by retaining the portrait of Kenya’s first president on the new generation currency notes.
In reply, the CBK said there was adequate public participation and stakeholder engagement before the notes were printed.
Mr Patrick Njoroge said these parties were also involved in the design work and that the petitioners' claims lacked legal basis.
“I believe if Okiya Omtatah were interested in participating in the design process, he [would have done so] from the moment the notices were issued - on March 7, 2012 - until there issuance,” he said.
On June this year, CBK unveiled new bank notes, a move that was intended to stem the fight against corruption, which is spearheaded by President Uhuru Kenyatta.
