Renowned socio-political commentator and legal analyst Steve Ogolla contends that Henry Rotich should not be put on half salary following his indictment over corruption.

In a tweet on Wednesday, the lawyer argued that the appointment of former Marsabit Governor Ukur Yattani as Finance Cabinet Secretary in an acting capacity meant that Henry Rotich had been effectively fired.

Ogolla said that Yattani's appointment was a stop-gap measure pending a substantive appointment, challenging the legality of paying Rotich half salary as he faces corruption charges in a court of law.

"HENRY ROTICH cannot lawfully be on half salary. He's fired. Article 132(2) of the Constitution permits the President to dismiss Cabinet Secretaries for whatever reason that may enter his imagination. Appointment of Ukur Yattani is a stop-gap measure pending substantive placement," Steve Ogolla tweeted.

State House's statement on the acting CS's appointment fell short of weighing in on whether Rotich has been fired.

The Director of Public Prosecutions (DPP) Noordin Hajji levelled a raft of charges against the Finance CS including engaging in a project without prior planning and not following procurement procedures.

Rotich and his co-accused were arraigned in court and released on bail on condition that they don't go back to their offices until their cases are determined.
