Senator Irungu Kang’ata has accused the Judiciary of failing former Nairobi Mayor Charles Rubia who is now deceased in the Sh40 billion torture case.
Speaking during his burial on Monday, Kang’ata said that the Judiciary had the mandate to ensure Rubia is compensated but nothing was done until his death.
“Charles Rubia has been given various commendations but the Judiciary of the Republic of Kenya has failed him. How can Rubia file a case way back in 2012 and now eight years down the line and the case is still pending in court, is that fair?’ he posed.
The deceased has been seeking the highest-ever compensation of Sh40 billion after he was tortured during the era of the former President Daniel Arap Moi. He sought legal redressed after the torture and detention after his business, health, and family.
The senator said that he was disappointed after the court failed to ensure he gets justice before his last days on earth. The senator has now asked the government to ensure that the family gets compensation.
However, In a tweet on Monday, Itumbi said that Kang’ata has clearly shown that the conflict of interest debate does not cut across the board.
“Senator @HonKangata tells mourners In Muranga he is Charles Rubia's lawyer and has been acting as his lawyer from 2012. Is that admitting Conflict of Interest? But let us allow that to pass unnoticed. Until @kipmurkomen appears in court," read his tweet.
Several leaders were present during the burial including President Uhuru Kenyatta. Uhuru said that the death of the veteran politician is a big blow to the entire nation.
