Mariga who had been initially locked out of Kibra constituency by-elections by IEBC was later cleared by the IEBC's tribunal to vie on a Jubilee Party ticket

However, Peter Moris Kinyanjui filed a petition claiming that Mariga was nominated illegally and it was against the party's constitution.

In the petition filed by Kinyanjui at the Political Parties Tribunal, he claimed that the Jubilee Party failed by not conducting free and fair party nominations.

As per the text message he received that invited him to the interview, the party must have used the interview to determine the suitable person to carry the Jubilee flag. This was against the law.

Upon seeking clarification from the party, he was assured that the nomination exercise would be conducted as per the party's constitution.

However, he was shocked when he received information from the Jubilee Election Board that Mariga was the Jubilee Party nominee for Kibra by-elections which is scheduled to be conducted on November 7

His efforts to appeal were dismissed by the National Appeal Tribunal forcing him to turn to Political Parties Tribunal.
