A magistrate based in Malindi county could land in trouble after a defilement suspect accused her of not paying any attention during the hearing of his case.
54-year-old Turkish Tycoon Elsek Osman has since filed a petition accusing Justice Dr Julie Oseko of chatting on her phone during the hearing and repeatedly left the chambers.
He says that the judge repeatedly left the courtroom to attend to calls and was also busy surfing online, which he says resulted in gaps during the proceedings and distortion of testimony.
Through his lawyers Cliff Ombeta and Daniel Wamotsa, he says that Ms Oseko “was not attentive while presiding over the matter, leading to glaring errors in the proceedings as well as missing evidence in his favour."
The suspect who is facing ten defilement charges for allegedly assaulting two minors says that consequently, what the judge recorded doesn't match the actual testimonies.
"Dr Oseko was texting, making calls and using her phone surfing on the internet on several occasions hence disrupting the court proceedings,” further reads the petition.
The claims were confirmed by witnesses advocate Maurice Mkan, who swore an affidavit confirming the same.
Consequently, the magistrate could be summoned by her employer; the Judicial Service Commission (JSC) to answer to the allegations levelled against her.
