A court sitting in Nairobi on Friday dismissed a petition filed seeking to have Kenya withdraw from maritime case with Somalia from International Court of Justice.

Justice Kanyi Kimondo on Friday said the issues raised were legislative and other intervention beyond the court's jurisdictions.

Through lawyer Kibe Mungai with twenty other Kenyans had challenged the decision by Kenya to participate in the process, arguing that it interferes with sovereignty.

But through lawyer Paul Nyamodi, the government insisted that the process was legal and in good faith for peace and stability.

He said Kenya has taken steps calculated at ensuring the best interest of its citizens, territorial integrity and independence, is not compromised

And Mr Nyamodi added that the petitioners have not shown any filing before the ICJ, which is unconstitutional.

“Kenya will participate responsibly before the ICJ. The petition is not merited because it invites the court to agree with the assumptions of the petitioners,” he argued.

Kenya is set to face Somalia on June this year over the Indian Ocean maritime dispute, with the ICJ set to make a determination.

Although the country is ready for court determination, there are efforts to push for out of court settlement but yet to bear any fruits.
