Kiambu Governor Ferdinand Waititu has a case to answer, the Ethics and Anti-Corruption Commission (EACC) has insisted.
On Monday, the anti-graft body asked the court to dismiss Waititu's application seeking to stop the case against him.
EACC argued that Waititu’s application claiming that the anti-graft agency was harassing him, and had accessed his property and confiscated documents using illegal search warrants was premature.
According to the commission, all legal processes were followed in Waititu's case.
"The application is frivolous, incompetent and improperly before court and an abuse of court process," EACC argued.
However, according to Waititu, the commission conducted an illegal raid at his homes, and therefore any information secured during the raid should not be used against him in court.
In his application, the governor wants EACC ordered to return all the documents and other items confiscated during the raid.
"The search warrant was formulated and crafted in a manner that designed to be a catch fall trap and instrument that allowed the EACC to turn upside down and ransack my houses and belongings,”Waititu's affidavit read in part.
The governor, his wife, and their daughter are being investigated for allegedly being involved in misappropriation of millions of shillings in Kiambu County.
