Nairobi Senator Johnson Sakaja has faulted his colleagues Kipchumba Murkomen (Elgeyo Marakwet) and Mutula Kilonzo Junior (Makueni) for being part of Nairobi Governor Mike Sonko's defence team.
The duo represented Sonko at the Milimani Law Courts on Monday when he was charged with multiple corruption-related crimes which he all denied.
Sakaja censured his colleagues, saying they should not act as Sonko's lawyers since a conflict of interest would arise in case he is brought to the Senate for grilling.
"There is a serious conflict of interest when the leader of majority and the minority whip are the ones representing a governor, or any governor whose matter is likely to come to the same house that they are in leadership position," he said in an interview with KTN on Monday.
Murkomen is the majority leader in the Senate while Mutula is the minority whip.
City lawyer Steve Ogolla agreed with Sakaja, saying Senators are constitutionally obliged and paid to oversight counties and, therefore, the two have 'no right' to be Sonko's advocates.
"The Senate has a special mandate to oversight counties. As a consequence, Sen. Murkomen and Mutula Kilonzo have no right to appear in court on behalf of Gov. Sonko, unless they want to create the crisis of reverse oversight. The conflict of interest is massive and irreconcilable," Ogolla stated.
