Peter Nderitu, the owner of Simmers Bar and Restaurant and the recently demolished Pimp My Ride car wash has landed in more trouble.
Barely a fortnight after the county government of Nairobi brought down the establishment, a businessman has sought to sue him, claiming that Nderitu coned him Sh5.6 million.
Harun Muiruri Ndungu is demanding the money back on claims that the accused defrauded him, claiming that he would lease him the plot located within the Nairobi CBD.
Muiruri who says that he wanted to set up a chemist on the plot has brought the issue to the attention of the Directorate of Criminal Investigations (DCI).
According to him, this comes after a futile search for police intervention.
“He (Nderitu) told me that he was acting as an agent to the property where the former Simmers Restaurant which had been demolished a few months ago was,” reads the letter in part, as was seen by the Standard.
He now wants the accused nabbed, claiming that he paid the money in six instalments, through cheques.
Ndungu adds that the accused resorted to writing him bouncing cheques upon demands for a refund.
According to Ndungu, the accused wanted him to take up the land without the proper documentation, which he rejected.
"I notified him (Mr Nderitu) that I could not take up space without the necessary documents as a company policy...if he is not in a position to have the documents ready and availed to me, it would be advisable that he returns the monies," he said.
