The Director of Public Prosecution has suffered a major blow after the court on Thursday his rejected his application to revoke the bail term granted to Samburu Governor Moses Lenolkulal was thrown out.
The court ruled that there is no evidence to prove that the county boss has interfered with witnesses as alleged by the DPP.
“On a scale of justice the court declines to issue the orders asked by the prosecution and dismiss the application,” the Magistrate ruled.
The DPP had applied for the cancellation of the bail given to the governor after he went ahead to reorganize his cabinet.
DPP Haji Noordin told the court that Lenolkulal had overstepped his mandate after he was also barred from accessing his office.
The prosecution claimed that the governor went against the tough conditions issued by the court and went on to introduce some changes to his team when he was out of office.
The court had given the county boss a cash bail of Sh.100 million or Sh.150 million bond. The county boss was arrested over charges of corruption and abuse of office.
He has since maintained that he is innocent and wants justice served to him. The governor will only access his office after the case is heard and determined.
