The High Court in Nairobi has temporarily stopped the hearing of case where embattled former Nairobi County Governor Dr Evans Kidero is charged with alleged theft of Sh213 million.
On Thursday, High Court Judge John Onyiego suspended the hearing of the case which had been scheduled to continue on Monday next week.
The Judge suspended the hearing pending a ruling on an application filed by Kidero challenging his prosecution.
Kidero moved to the High court challenging a conspiracy charge leveled against him by the Director of Public Prosecution (DPP).
In the application, Kidero through his lawyer James Orengo, claims that the conspiracy charge leveled against him by the DPP is is defective, and wants it removed from the charge sheet.
The troubled former governor also wants to be tried separately in a case involving other accused persons.
“I hereby stay the proceedings in the anti-corruption magistrate court on this matter, pending a comprehensive ruling on the application on May 7, 2019,” Judge Onyiego ruled on Thursday.
Last month, Milimani anti-corruption Chief Magistrate Douglas Ogoti dismissed Kidero’s application to be tried separately.
In the case, Kidero and 10 other suspects were charged in 2018 for allegedly conspiring to defraud the Nairobi county government of Sh213 Million.
The former governor is allegedly said to have committed the offense between January 16, 2014, and January 25, 2016. He (Kidero) and others pleaded not guilty to the charges.
