Proland Limited and Iris Properties companies had their warrant of arrests for four Nairobi County officers barred by the High Court on Monday.
The two companies had obtained orders to have the four officers, Simon Morintat Leboo, Pauline Kahiga, Halkano D. Waqo and Johson Akongo, arrested over Sh35 million Nairobi County owes them.
However, the four told the High Court that they have no powers to pay them. They noted that their arms are tied when it comes to dealing with the Nairobi County finances.
The four also told the court that the two companies have orders to arrest them while at their homes.
“The warrants are being executed against the said applicants or threatened to be executed against the accused persons in their homes at 3 am and against their families contrary to the law,” the court was told.
Previously, Proland Ltd had invaded Morintat's home. They attacked his family before picking them for questioning.
According to their lawyer George Kithy, the director of the company stormed Morintat's home with police officers.
They also arrested his daughter. The male police who took her allegedly molested her and later set her free.
“This is not a police state for heaven’s sake, as we get to court to be heard the Inspector General has deployed a contingent of General Service Unit officers at the premises of applicants,” Kithy said.
