Barely a fortnight after dumping DP William Ruto for powerful Interior Cabinet Secretary, County MP Jerusha Momanyi could now be forced to let go her NGAAF coordinator.

A ruling by Justice Nduma Nderi of Employment and Labour Relations Court in Kisumu, found culpable Ms Momanyi, Kenya School of Government and NGAAF of violating article 47 of the constitution.

Activist Vincent Omao had moved to court challenging recruitment of NGAAF coordinator in Nyamira, arguing that the best candidate was not absorbed by the recruiters and was not given any reason.

"The person who emerged the best was not given the job. Instead, they came up with someone who did not even reach the threshold. That's why I filed the petition," said Mr Omao on Friday.

In his judgment, Justice Nderi observed that NGAAF, KSG and Mrs Momanyi's offices acted in contravention of the law by discriminating one Jared Ongiri.

"It's my order that the recruitment did not uphold the constitution as out forth by the petitioner. I hereby declare that the holder was not absorbed in accordance with the law," read part of the judgment.

The latest development has thrown Mrs Momanyi to a limbo since NGAAF could be forced to recruit a coordinator fresh, a move that could derail her activities across the county.

But according to the Jubilee MP, the ruling will not affect operations since the holder will continue being in office until the court orders are implemented.

"In my view, operations will continue as scheduled. In any case recruitment shall be done, the current holder shall execute duties until then," she said.

Mrs Momanyi was one of staunch supporters of Dr Ruto and her exit came as a shock. She has since endorsed Dr Matiang'i's presidential bid.
