Chief Justice David Maraga's morality to the rule of law will be tested once more in October as election petitions come to a culmination.
The Chief Justice will be selecting a bench that will listen and determine a case challenging Governor John Nyagarama's re-election.
Former Kitutu Masaba MP Walter Nyambati, who also served as Jomo Kenyatta Foundation chair filed the petition where he wants Supreme Court to nullify Nyamira gubernatorial election results.
In July, Maraga admitted being a childhood friend to Nyagarama besides coming from the same village.
"I am sympathetic to my brother John Nyagarama for losing his son. We have been friends for a long time besides sharing same village," he said, a confession that could lead to resistance from team Nyambati.
Both come from Nyamwetureko village in West Mugirango Constituency and have been childhood friends.
An aide from Nyambati's team says the statement would not be taken lightly and that they may challenge the CJ's involvement in the case.
"They are friends and comes from same village. We want fairness that is why we want him to bolt out from the matter," he said.
On 5th October, a pre-trial conference will be held in the Supreme Court where formalities on how the case will be handled is expected to be discussed.
Thereafter, Maraga, or his deputy Philomena Mwilu are expected to chose three judges who will listen to the gubernatorial petition.
