Justice Aggrey Muchelule has thrown out a suit where a 29-year-old man sued his father for upkeep, and demanded that he funds his university education.
He was demanding for Sh2.8 million for his college fees.
Muchelule has thrown out Allan Njau Waiyaki's suit against his father Eddie Waiyaki Hinga on grounds that he is too old to be supported and also has a steady income.
This is after the judge learnt that Njau, who is pursuing a masters degree in terrorism and security studies, is a director and a shareholder in a petroleum company.
The judge ruled that the man is far over the age of 18 and should be supporting himself.
Earlier, Waiyaki argued that his son got Sh2.9 million profit from his petroleum company affiliated to Vivo Energy, which is enough to fund his masters degree programme.
He also told the court that he supported him up to age 22, four years past the required 18, as is reported by the Monday Standard.
Njau, however, argued that his mother had given him Sh2.6 million and his father, having an equal responsibility of looking after him, and being a man of means, should do the same.
“It is against my right to education for my father to discontinue my education prematurely. The respondent is a man of means and he has the ability to educate me,” he had told the lower court, which dismissed his case, resulting in a appeal at the High Court.
Njau was also directed to pay his father the cost of the suit.
