Former Subukia lawmaker Koigi Wa Wamwere now says that the nation would be thrown into a constitutional crisis should it witness a continuation of the ongoing offensive on the judiciary.
Coming amid an ongoing graft case against Deputy Chief Justice Philomena Mwilu, Koigi noted that the nation would have it harder solving the puzzle should Chief Justice David Maraga be as well prosecuted for whatever reasons.
Terming it unrealistic for lower ranked judges to judge their seniors, he said that his immediate juniors would better off handle Maraga's case at the Supreme Court, where he is the President.
"He cannot escape prosecution simply because he is bigger than all judges. Instead, it is better having him arraigned before his Supreme Court judges as he cannot, also, be judged by his juniors," said Koigi on Sauti Ya Mwananchi Radio on Saturday.
This comes amid a puzzling scenario in Mwilu's case where her proceedings are being handled by Chief Magistrate of the Anti Corruption Court Lawrence Mugambi, despite being the second highest judge in the nation.
According to Koigi, should the remaining Supreme Court judges refuse or demonstrate the unwillingness to handle the case for whatever reasons, they should then be dismissed.
"They should then be sacked for failing to do their job," he added.
