Nyamira MCAs have vowed to continue with the process of impeaching Executive Committee Member (ECM) for Public Service Management, who they accuse of corruption and abuse of office.

This comes after the ECM, Mr Bernard Osumo, sought court’s intervention that could see the assembly barred from continuing with the impeachment process until the case is heard on 29th July this year.

He is accused of misappropriating Sh24 million meant to pay six workers for a period of three years.

The orders, served to the assembly through the speaker generated a heated debate in the house Thursday afternoon.

The case has been filed at the labor and employment relations court in Kisumu.

They have however vowed to ignore the orders and continue with the process of impeaching the ECM saying Mr Osumo was trying to intimidate and gag the assembly using the Kisumu based court.

Magombo ward representative Mr. Richard Onyinkwa said that the court had no powers to interfere with the assembly’s proceedings terming the orders illegal and breach of separation of powers.

“We are not going to obey the orders whatsoever, the assembly is being threatened and this is the time all of us need to be arrested for court contempt is by disobeying the orders, this is a clear breach of separation of powers,” he said.

Onyinkwa asked Governor John Nyagarama to stand in the safe side of history and suspend the ECM if he meant well for the electorates and employees who suffered under the watch of the County Minister.

“If the Governor (John Nyagarama) is with this assembly which represents the residents who voted him in, then the minister should be suspended by now to give room for investigation of the allegations leveled against him,” he added.

His Esise ward counterpart Mr Joseph Nyarang’o called on the ward representative to match to the embattled ECM’s office, eject him and close it.

“It’s high time the public knew who is for and against them, he now feels his job is threatened and has rushed to court to stop his removal from office when he watched employees with families and bills to pay suffer for three years, we will match to his office ,eject him and close it,” said Nyarang’o.

Mr Osumo’s impeachment motion was passed on 23rd April with 25 members voting in support of his removal. Only five voted in his favor.

The assembly adjourned for a recess till 4th June 2019. Other committee sittings will be on during the recess.
